These Terms of Service ("Terms") govern your use of the SC Portal Mobile app for Android (package io.sitecommander.portal) and iOS (the "App"), published by E-Tech Sales LLC ("E-Tech," "we," "us"). The App is the mobile companion to Site Commander, an on-premises security and communications platform operated by the facility that enrolled your device (your "Facility"). By installing, enrolling, or using the App you agree to these Terms. If you do not agree, do not use the App.
The App is a workforce tool for staff whom a Facility has authorized. There is no public sign-up: your device is enrolled with a one-time code issued by your Facility's Site Commander administrator. You may use the App only if you are an authorized member of that Facility's staff, you are at least 18 years old or otherwise permitted by your Facility to use it, and your Facility's policies allow it. The App is not directed to children.
Subject to these Terms, E-Tech grants you a limited, revocable, non-exclusive, non-transferable license to install and use the App on a mobile device you control, solely for your Facility's security and communications operations. You may not copy, modify, distribute, sell, lease, or sublicense the App; reverse engineer or attempt to extract its source code except where the law expressly permits; use it to build a competing product; or remove any proprietary notices. The App and Site Commander are protected by copyright and other intellectual-property laws and remain the property of E-Tech and its licensors. The App is licensed, not sold.
Your Facility, not E-Tech, decides which actions and notifications appear in your App, which devices are enrolled, and when access is revoked. The buttons you see act on your Facility's own Site Commander server and the systems it controls (for example doors, announcements, and emergency profiles). Your Facility is responsible for how it configures Site Commander, for who it enrolls, and for its own emergency plans and procedures.

A Facility may discipline, and E-Tech may suspend, any use that violates these Terms.
The App can trigger emergency responses and deliver emergency notifications, but it depends on your device, its settings and battery, cellular and Wi-Fi networks, Google Firebase Cloud Messaging and Apple push services, and your Facility's own server and equipment, none of which E-Tech controls end to end. E-Tech does not guarantee that any action will execute, or that any notification will be delivered, within any particular time or at all. The App is not a substitute for your Facility's emergency procedures or for contacting emergency services. In an emergency, call your local emergency number (911 in the United States).
The App is designed to deliver operational security and emergency push notifications from your Facility, and by enrolling you consent to receive them. You can disable notifications in your device settings, but you will then not receive your Facility's alerts. Message and data rates from your carrier may apply.
How the App handles data is described in the SC Portal Mobile Privacy Policy. In short: the App stores an enrollment key and your Facility's server address on the device, registers a push token with Google Firebase Cloud Messaging, and collects no name, email, phone number, contacts, location, or advertising identifier. We do not sell your information.
The App is distributed through Google Play and the Apple App Store, and their terms also apply to your download. Push delivery uses Google Firebase Cloud Messaging and, on iOS, Apple Push Notification service, under those providers' own terms. Google and Apple are not parties to these Terms and have no obligation to provide support or maintenance for the App.
We may update the App, add or remove features, or require you to install an update to keep using it. We may suspend or discontinue the App, in whole or in part, at any time. Your Facility may suspend or discontinue its Site Commander service independently of us.
Your Facility may revoke your device at any time, and E-Tech may suspend or terminate your access if you breach these Terms. You may stop using the App at any time by choosing Reset in the App or by uninstalling it, which removes the enrollment data stored on your device. Sections 2, 5, and 11 through 14 survive termination.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, E-TECH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, E-TECH AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, HOWEVER CAUSED. E-TECH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Nothing in these Terms limits liability that cannot be limited by law. Your Facility's rights and remedies against E-Tech, if any, are set out in its own agreement with E-Tech, not in these Terms.
To the extent permitted by law, you agree to indemnify and hold E-Tech harmless from claims, damages, and reasonable costs arising from your misuse of the App or your breach of these Terms.
These Terms are governed by the laws of the State of Oklahoma and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Oklahoma, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the rest remains in effect.
We may update these Terms as the App evolves. Material changes will be reflected here with a revised effective date, and continued use of the App after a change means you accept the updated Terms.
